This policy explains how Sexton LLC, doing business as Apex Solar ("we," "us," or "our"), collects, uses, and protects personal information. It applies to theapexsolar.com and to the phone, email, and text message communications we have with customers and prospective customers.

Information we collect

We collect the following categories of information:

• Contact information you give us directly, such as your name, home address, phone number, and email address.
• Property and energy information needed to prepare a proposal, such as your utility provider, your usage history, copies of electric bills you provide, and your roof's measurements, orientation, and shading.
• Communication records, including emails, text messages, and notes from calls and consultations.
• Proposal and agreement records, such as the proposals we prepare for you and any agreement you sign. We do not collect or store payment card or bank account numbers.

This website does not use analytics services, advertising trackers, or third-party cookies.

How we use information

We use the information above only to:

• respond to questions and requests you send us;
• schedule and hold solar consultations;
• prepare a proposal for your property and review it with you;
• explain the purchase and financing options available for your project;
• complete an agreement if you decide to move forward, and pass the project to the installation company that will perform the work;
• send messages about your consultation or project, including scheduling, confirmations, and follow-up; and
• meet legal, tax, and licensing obligations.

We do not sell personal information. We do not rent, trade, or otherwise disclose personal information to third parties or affiliates for their own marketing or promotional purposes.

SMS and text messaging

We send text messages only to people who have given consent to receive them, and only about their consultation or project. Message frequency varies by the status of your project, up to 6 messages per month. Message and data rates may apply. Reply STOP to any message to opt out, or reply HELP for help. Your mobile number and your consent to receive text messages are used solely to send you the messages described above. Records of your opt-in and any opt-out request are retained only so that we can honor your choice and demonstrate compliance with messaging regulations.

When information is disclosed

Subject to the SMS section above, information is disclosed only in these limited situations:

• Service providers that perform work on our behalf and only as needed to do it, such as our text messaging provider and the scheduling and customer record software we use. They may use the information only to provide that service to us.
• The installation company assigned to your project, if you sign an agreement, so that it can design, permit, and install your system. That company handles your information under its own privacy policy, which we will identify to you.
• Legal requirements, when disclosure is required by law, subpoena, or court order, or to establish or defend legal claims.

None of these situations permit the disclosure of text messaging originator opt-in data or consent, which is never shared with any third party.

How long we keep information

Proposal and agreement records are kept as long as needed for tax and legal purposes. Records from consultations that do not move forward are kept no longer than necessary for our business records. Opt-out records are kept indefinitely so that we do not message you again after you opt out.

Security

We use reasonable administrative and technical safeguards to protect personal information, and we limit access to people who need it to perform their work. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Your choices and how to request deletion

You may, at any time:

• request a copy of the personal information we hold about you;
• ask us to correct information that is inaccurate;
• ask us to delete your personal information, which we will do unless we are required to keep it for tax or other legal reasons — in that case we will tell you what we are keeping and why;
• stop text messages by replying STOP to any message, or stop email by contacting us directly.

To make any of these requests, contact us using the details below. We may need to verify your identity before acting on a request, and we will respond within a reasonable time.

Children

Our services are directed to property owners and are not intended for children under 13. We do not knowingly collect personal information from children under 13.

Changes to this policy

If this policy changes, we will post the updated version on this page and revise the "Last updated" date above.
